Recientemente se ha dado a conocer la Instrucción 4/2014, de 9 de diciembre, del Departamento de Recaudación de la AEAT, sobre gestión de aplazamientos y fraccionamientos de pago, en la que se tratan de homogeneizar, coordinar y aclarar los criterios de actuación y las condiciones de la resolución por parte de los órganos de recaudación. Adicionalmente también se incorporan las instrucciones para proceder en los casos de deudores en situación pre concursal.

Dichas pautas de actuación se aplicaran a las solicitudes de aplazamiento o fraccionamiento cuya resolución competa a los órganos de Recaudación, tanto si se trata de solicitudes de resolución automatizada (RAM) como si no lo son. Se excluyen del ámbito de aplicación las solicitudes de aplazamiento o fraccionamiento de deudas de responsabilidad civil por delitos contra la Hacienda Pública y las solicitudes de fraccionamiento o aplazamiento de pago de deudas que tienen la consideración de retenciones o ingresos a cuenta y las de deudores en situación de concurso.
