De acuerdo con el dictamen emitido por la Comisión europea, se “establece un régimen de declaración fiscal en el marco del Modelo 720 que parece discriminatorio y desproporcionado a la luz de la jurisprudencia pertinente del Tribunal de Justicia".

Esaú Alarcón García y Alejandro del Campo Zafra, asociados de AEDAF, han participado en el proceso de denuncia ante la Comisión Europea y señalan que "el Ejecutivo Europeo opina que se quebrantan cinco de las libertades comunitarias. A ello nos permitimos añadir que se incumplen también varios principios constitucionales: seguridad jurídica, tutela judicial efectiva (imposibilidad de prueba), capacidad económica, derecho de propiedad, igualdad".
