Finalizado el encuentro más importante del año, en el que se debatieron cuestiones de máxima actualidad, presentamos aquí las Conclusiones.

Entre los aspectos más relevantes de las Conclusiones de este encuentro, figura la imposición de sanciones tributarias, sobre la que el Tribunal Supremo, tal y como se expuso en una de las ponencias, ha encuadrado las pautas imprescindibles a seguir, y ha recordado que, de no cumplirse éstas, las sanciones resultan "nulas de pleno de derecho" ante la falta de motivación.

En materia de Fiscalidad Internacional, se comentaron los dos procedimientos que la Comisión Europea ha iniciado contra España relativos al cambio de residencia y al tratamiento de dividendos a no residentes. En este punto, se alertó de que, a tenor de los últimos pronunciamientos del TJCE, "Europa podría terminar considerando la normativa española contraria a las libertades comunitarias".

Sobre las operaciones vinculadas se entiende que el ajuste secundario previsto en el Impuesto de Sociedades supone, en determinados casos, "una doble imposición que no es deseada ni por la propia Ley [de Prevención del Fraude], ni por la OCDE sobre precios de Transferencia". Este "exceso reglamentario" debería paliarse habilitando la posibilidad de que el contribuyente pueda rectificar contablemente la diferencia de valor aceptada, sin que sea necesario practicar este ajuste.
